Forest Rock Terms & Conditions & Waiver of Liability & Release Agreement
In consideration of my participation in a Forest Rock Qigong and associated events, activities and the services of Forest Rock Qigong, its agents, owners, officers, volunteers, participants, employees, sponsors and all other persons or entities acting in any capacity on its behalf, as well as its successor and assigns (collectively referred to as “Forest Rock Qigong”), I, on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative and estate (collectively referred to as “Participant”), hereby agree to release and discharge Forest Rock Qigong as follows:
Enrolment Deposit and Payments for Enrolments
When choosing to pay a deposit only, you are agreeing to pay all tuition and fees on time. Training rates are in USD per person.
Payments are accepted by credit card or via International Bank Transfer in USD or using wise.com.
Please note that overseas bank transfers and credit card payments may be subject to additional international transaction fees that are not included in the training price. You are responsible to pay all banking fees.
In order to qualify for an Early Bird discount, Forest Rock Qigong must receive full payment by the date specified for this offer. Early Bird payment will not be available after that date.
In order to process your application, you must submit a non-refundable, deposit or pay the full amount. This deposit must be submitted by credit card through the website or via wise.com. In all cases, the deposit is non-refundable. The deposit will be deducted from the total tuition of the course.
All training fees must be paid in full 60 days prior to the start of the training. If you are booking the training less than 60 days prior to the start of the training, the course must be paid in full upon application.
Cancellation & Refund Policy
Due to organisational expenses, fixed traveling costs of our teaching team, and the accommodation reservations in advance, the paid training fee including the Deposit / Registration Fee (for trainings paid in full) and Deposit (for reserving your place) is strictly non-refundable, non-cancelable and non-transferable. If you need to cancel the course due to unavoidable reasons, the course fee (excluding registration/deposit fee) can be transferred to any future course with Forest Rock Qigong within two years from the starting date of your originally booked course.
You are liable for any additional fees incurred from the hotel due to cancellation of your accommodation. That money will be deducted from their fee and will not be transferable on future courses.
To reschedule your training, you must inform us at least one month before the starting date of your rescheduled course, otherwise you may lose your course fee entirely (you may also need to apply for the course again and pay the registration fee).
There is a strictly no refund policy if you begin the training and pull out for reasons other than the death of an immediate family member.
Travel and Cancellation Insurance
Travel Insurance coverage is mandatory to attend a Forest Rock Qigong training. With most agencies, insurance must be purchased within 7 days of making your reservation. Please be sure that your insurance policy covers you for all relevant sport activities that you will be engaging in during your Bali training & trip cancellation. Depending on the policy and conditions, travel cancellation insurance will pay for some or all cancellation fees.
Unplanned Changes or Cancellations of the Scheduled Course
It is very unlikely that we shall have to change the course venue or cancel the scheduled course; however, we reserve the right to do so in case of natural calamities and like. If the Training Program is cancelled by Forest Rock Qigong, we will refund 100% of the fee paid, minus the non-refundable registration/deposit fee by the applicant or offer an alternate placement. However, Forest Rock Qigong is not responsible for any other cancellations like flights, etc. Or any other expenses incurred by the applicant.
Please note, at this stage we are not offering any cash refunds. You can transfer your payment to a future live or online training within a two year time period.
Death
a. Prior to the Training
In the event of Death (the individual who booked the program passes away), we will process a full refund of money received less the registration/deposit charge that will be deducted from the total funds paid due to our financial commitments for that event.
Please note: A death certificate must be produced to process this refund. Forest Rock Qigong will not be liable for bank charges or international currency fluctuations when refunds are processed.
b. During the Event
In the event of Death during the training (the individual who attends the program passes away), we do NOT refund any funds received due to our financial commitments to the event.
Please note: The emergency contact person provided by the attendee is to assume the responsibility of the process that occurs as soon as the emergency begins and our team contacts you. All attendees MUST HAVE travel insurance to attend our trainings.
Teaching Staff Reshuffle
Due to certain unavoidable circumstances, organisational issues, teachers personal commitments, teaching staff may change at certain times. However, Forest Rock Qigong strives to provide the best teachers for Teacher Training programs in the best interests of the students and the school. Any decision in this regard by Forest Rock Qigong management is final.
Attendance
Forest Rock Qigong is a registered company conducting professional Qigong Teacher Training courses and issues certificates based on the completion of the necessary hours and competence of the trainees. Hence 100% attendance is required in order to receive certification. Our programs are intensive and demand compulsory attendance for compulsory contact hours of training. This includes all excursions as they are a part of your training hours. In case of continuous absence, except in serious medical conditions, the participant may not receive certification and additional hours of study on a future training will be required.
If the student has any slight sickness and unable to practice in class, we strongly encourage such students to attend the class and observe the teachings. In our experience we have noticed that being present and observing the class can still help the students to assimilate the teachings.
Punctuality
We request all the students to arrive for the classes at least 10 minutes in advance and be settled down before the class begins.
Health and Fitness Issues
Students are expected to take responsibility for themselves and are solely responsible for their own safety, health and general well-being during the training program. Our training programs or not suitable for people who are rehabilitating from or on medication for severe physical or psychological conditions. In case of any medical problem or emotional crisis we are there to extend our help and support including arranging medical advice during the training.
It is essential that you come to the training rested and in good health and allow time after the training to integrate the teachings.
Drugs and Alcohol
Consuming drugs, alcohol prior to any classes is strictly prohibited during the training programs. Consuming these substances will be counterproductive of your Qigong practice.
Waiver of Liability and Release
Participant does hereby release and forever discharge Forest Rock Qigong from any and all liability, claims and causes in action, which arise or may hereafter arise or are in any way connected to the Participant’s involvement in the Training.
Participant understands that this Agreement discharges Forest Rock Qigong from any liability or claim that the Participant may have against Forest Rock Qigong with respect to any bodily injury, personal injury, illness, death, or property damage that may result from the Participant’s involvement in the Retreat, whether caused by the negligence of Forest Rock Qigong, or otherwise.
Participant also understands that Forest Rock Qigong does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health or disability insurance in the event of injury or illness.
Participant understands and acknowledges that the Activities, in which Participant will voluntarily engage in at the Retreat bear certain known inherent risks that contribute to the unique character of these Activities and that Forest Rock Qigong cannot eliminate, alter or control these inherent risks. These risks include those inherent in Qigong activities, as well as those inherent in recreational activities.
Indemnification and Hold Harmless
Participant hereby agrees to indemnify and hold harmless Forest Rock Qigong from any liability, claims and causes in action, which are in any way connected to Participant’s involvement in the Retreat, or use of Forest Rock facilities or equipment, including any such claims, which allege negligent acts or omissions of Forest Rock Qigong.
Medical Care
Participant does hereby release and forever discharge Forest Rock Qigong from any liability, claims, and causes in action that arise or may hereafter arise on account of any first aid, treatment, or service rendered or not rendered in connection with the Participant’s involvement in a Training.
Certification and Assumption of Risk
Participant hereby certifies that he/she is physically fit, has trained sufficiently for participation in the Training/Retreat and has not been advised otherwise by a qualified medical person. Participant agrees that Forest Rock Qigong is not qualified to evaluate the Participant or Participant’s fitness for involvement in the Training/Retreat. The Participant must determine if he or she is sufficiently fit to participate. Participant hereby expressly and specifically assumes the risk of injury or harm in the Participant’s involvement in the Training, including, but not limited to all Risks. The Participant agrees that his/her involvement in the Training is purely voluntary, and Participant elects to participate in the Training in spite of the Risks.
Definitions
“Activities” include, but are not limited to the following activities, which may be provided by Forest Rock Qigong: Qigong practice, excursions, transportation in Forest Rock Qigong or other vehicles, training, classes, instruction, traveling to and from the Training/Retreat, and all other activities associated with the Training/Retreat.
“Risks” include, but are not limited to those known risks inherent to the Activities specifically listed below, vehicular travel and traffic, road and trail conditions, known and unknown health conditions, allergies, sudden weather changes, rain, wind, hail, lightening, high altitude or motion sickness, dehydration, heat stroke, snake bite, bee and other insect stings and/or bites, wild and domestic animals, inaccessibility to immediate medical attention, falling rocks and trees, equipment failure, driver error, rider error, Participant error, food provided, facilities, actions of other people, and acts of God.
Risks inherent in Qigong activities are dangers or conditions that are an integral part of Qigong activities, including but not limited to minor muscle strains, muscle sprains, post-exercise muscle soreness, joint injuries, torn muscles, heat-related illnesses, back injuries, stroke, heart attack, paralysis, death, and injury or death caused by any of the following: equipment that breaks or otherwise fails, slips and falls, lack of nutrition or hydration, negligence on the part of Participant or other people around Participant, terrain, facilities, temperature, weather, condition, equipment, actions of other people including, but not limited to, participants, volunteers, spectators, and teachers.
Personal Property
Participant acknowledges and agrees that he/she is responsible for his/her equipment and all personal property during the Training/Retreat and that Forest Rock Qigong is not responsible in any way for such property whether it is lost, stolen or damaged.
Photographic Release
Participant does hereby grant and convey unto Forest Rock Qigong all right, title and interest in any and all photographic images, video or audio recordings made by Forest Rock Qigong during the Training/Retreat, including but not limited to royalties, proceeds, or other benefits derived. Participant authorises Forest Rock Qigong to use such images, words, and likenesses for marketing, on websites, in brochures or other writings and any for any other legitimate purpose.
If for any reason the participant does not wish to be included in any film or photography footage, make a note at the end of this agreement and Forest Rock Qigong will do their best to keep you out of shots. Please note that there may be some instances where it is not possible to completely avoid and so the participant accepts that they may appear in some background footage.
Interpretation and Governing Law
This document shall be construed broadly to provide a release and waiver to the maximum extent permitted under Indonesian and New Zealand law. If any portion of this document shall be held as invalid it is agreed that the balance shall continue to be in full force and effect.
